Other offences in connection with equipment
(1)
If any person uses for trade, or has in his possession for use for trade, any weighing or measuring equipment which is false or unjust, he shall be guilty of an offence and the equipment shall be liable to be forfeited.
(2)
Without prejudice to the liability of any equipment to be forfeited, it shall be a defence for any person charged with an offence under subsection (1) in respect of the use for trade of any equipment to show —
that he used the equipment only in the course of his employment by some other person; and
that he neither knew, nor might reasonably have been expected to know, nor had any reason to suspect, the equipment to be false or unjust.
(3)
If any fraud is committed in the using of any weighing or measuring equipment for trade, the person committing the fraud and any other person who is a party thereto shall be guilty of an offence and the equipment shall be liable to be forfeited.
