Repeal and re-enactment of section 49
Section 49 of the principal Act is hereby repealed and the following substituted therefor: —“Notification of accidents and dangerous occurrences49.—
Where —
an accident in a factory —
causes loss of life to a person employed in the factory; or
disables any such person for more than three days from earning full wages at the work at which he was employed; or
causes any injury to any such person which requires such person to be detained in a hospital for at least twenty-four hours for observation or treatment; or
a dangerous occurrence takes place in a factory,written notice thereof in the form set out in the Ninth Schedule to this Act shall be sent forthwith to the Chief Inspector by the occupier of the factory.(2) Where a person employed is involved in an accident or a dangerous occurrence and the occupier of the factory is not the actual employer of the person killed or injured, the actual employer shall, instead of the occupier of the factory, forthwith send a written notice thereof in the form set out in the Ninth Schedule to this Act to the Chief Inspector.(3) Where an accident causing incapacity is notified under this section, and after notification thereof the person incapacitated dies, written notice of the death shall be sent to the Chief Inspector by the occupier of the factory or the employer of that person, as the case may be, as soon as the death comes to his knowledge.”.
