Clause 16

Amendment of section 27

Section 27 of the principal Act is amended —

(a)

by deleting subsection (1) thereof and substituting therefor the following: —“(1) Any person who —

(a)

has in his possession; or

(b)

exhibits or distributes,any obscene or lewd film shall be guilty of an offence under this Act and shall be liable on conviction —

(i)

in respect of an offence under paragraph (a) of this subsection, to a fine not exceeding five thousand dollars or to imprisonment for a term not exceeding six months or to both such fine and imprisonment; and

(ii)

in respect of an offence under paragraph (b) of this subsection, to a fine not exceeding ten thousand dollars or to imprisonment for a term not exceeding two years or to both such fine and imprisonment.”; and

(b)

by deleting the word “Cinematograph” in the second line of subsection (2) thereof.
