Clause 2

New section 29A

The Planning Act is amended by inserting, immediately after section 29 thereof, the following section: —“Development charge payable29A.—

(1)

Any development charge payable in respect of any land under subsection (1) of section 29 of this Act shall be —

(a)

at such rate as may be prescribed under subsection (1) of section 32 of this Act; or

(b)

equal to a prescribed percentage of any appreciation in the value of the land arising from any grant of permission to develop the land under subsection (1) of section 9 of this Act,whichever is the greater.(2) No development charge shall be payable under subsection (1) of section 29 of this Act if there is no appreciation in the value of the land arising from the grant of the permission to develop the land.(3) For the purposes of this section, the Chief Valuer or such other person as the Minister may appoint shall determine the amount of appreciation, if any, in the value of the land.”.
