Clause 66

Amendment of section 371

Section 371 of the Companies Act is amended —

(a)

by inserting, immediately after subsection (4), the following subsections:“(4A) The powers conferred upon the Registrar under subsection (4) in relation to offences under this Act that are punishable by a fine or a fine and default penalty shall extend to an offence committed under subsection (1) of section 169 even though such offence is punishable under section 171 by imprisonment or a fine.(4B) The power conferred upon the Registrar under subsection (4) shall only be exercised where the person admits the offence and agrees in writing to the offence being dealt with under that subsection.”; and

(b)

by inserting, immediately after the word “before” in the second line of subsection (6), the words “a Magistrate’s Court or”.
