Clause 33

Insurance by owner of a flat

(1)

Nothing in this Act shall limit or affect any right of the owner of a flat to effect insurance.

(2)

Insurance effected by the owner of a flat shall not affect, and shall not be taken into consideration in determining, the amount payable to a body corporate under a contract of insurance entered into between it and an insurer pursuant to this Act, notwithstanding anything contained in that contract of insurance.

(3)

A contract of insurance entered into as referred to in subsection (1) shall not be liable to be brought into contribution with any other contract of insurance except another contract of insurance which —

(a)

is in respect of damage to the same flat; and

(b)

relates to the same mortgage debt,as that referred to in the contract of insurance first-mentioned in this subsection.
