Clause 40
Record and inspection of vehicles, etc.
(1)
The Minister may make regulations to require persons having in their possession vehicles, vessels or aircraft, if required so to do by such competent authority or person as may be specified in the regulations —
to furnish to such authority or person as may be so specified a return containing such particulars as to the vehicles, vessels or aircraft, as may be required by or under the regulations; and
to afford all reasonable facilities for enabling any such vehicles, vessels or aircraft, in their possession to be inspected and examined, at such times as may be specified by or under the regulations, by such authority or person as may be so specified.
(2)
Without prejudice to any penalty under section 45, if any person is obstructed in the exercise of powers of inspection conferred on him by regulations made under this section a Magistrate may, if satisfied by information on oath that the person has been obstructed, issue a search warrant authorising an authorised officer named therein, accompanied by the said person, to enter the premises in respect of which the obstruction took place and to inspect any vehicles which may be found therein.
