Repeal and re-enactment of section 39B
Section 39B of the principal Act is repealed and the following section substituted therefor:“Special provisions relating to the sale by the Authority of a flat, house or building39B.—
Where —
a flat, house or building is sold by the Authority to any person under the provisions of this Part; or
any estate or interest in such flat, house or building is —
subsequently transferred by or to any person with the consent of the Authority; or
surrendered to the Authority,and a solicitor is not employed by such person to act for him in the transaction, the Authority may by its duly authorised officer act for such person.(2) Where the Authority acts for any person referred to in subsection (1), then for the purposes of the registration of any instrument relating to the sale of the flat, house or building or any transaction referred to in that subsection —
in the case of an instrument presented for registration under the Registration of Deeds Act (Cap. 281), section 12 of that Act shall not apply if a duly authorised officer of the Authority certifies that the flat, house or building has been sold under the provisions of this Part;
in the case of an instrument lodged for registration under the Land Titles Act (Cap. 276), a certificate of an officer of the Authority duly authorised by the Authority to act for such person referred to in subsection (1) shall be sufficient for the purposes of section 50 of that Act; and
a certificate by an officer of the Authority duly authorised by the Authority to act for such person referred to in subsection (1) shall be sufficient for the purposes of section 20(2) of the Residential Property Act 1976 (Act 18 of 1976).(3) Section 35 of the Legal Profession Act (Cap. 217) shall not apply to any officer of the Authority acting for any party to the transactions referred to in subsection (1).”.
