Clause 39

by deleting paragraph (b) of subsection (1) and substituting the following paragraphs:“(b)for damage to or destruction of any goods which have been duly acknowledged by the Authority to be in its custody (other than goods referred to in paragraph (c)) in the sum of more than $2,000 per package or unit of such goods;

for damage to or destruction of any goods contained in any container which have been duly acknowledged by the Authority to be in its custody, in the sum of more than —

$5,000 in the case of a container of up to 20 feet in length or $10,000 in the case of a container exceeding 20 feet in length; or

the actual cost of repair or replacement of such container and the goods packed in such container,whichever is the less.”; and

by inserting, immediately after subsection (2), the following subsection:“(3) For the purposes of this Part, where a container, pallet or similar article is used to consolidate goods, notwithstanding that the goods have been separately enumerated in the bill of lading as having been packed in such container, pallet or article, the resultant consolidation shall be deemed and shall count as one package or shipping unit.”.
