Clause 42

Performance at premises where persons reside or sleep, etc.

Where a literary, dramatic or musical work, or an adaptation of such a work, is performed in public, by the operation of any wireless telegraphy apparatus or telecommunication apparatus or by the use of a record, at premises —

(a)

where persons reside or sleep, as part of the amenities provided exclusively for residents or inmates of the premises or for those residents or inmates and their guests; or

(b)

where any trade or business is carried on (not being a place of entertainment) as part of the amenities provided for the occupiers, visitors or guests of those premises,the performance shall not constitute an infringement of the copyright in the work.
