Amendment of section 173

Section 173 of the Companies Act is amended —

(a)

by deleting the words “his consent in writing to appointment as such” in the second line of subsection (2) and substituting the words “a signed copy of his consent to act as director under this Act together with a prescribed statement that he is not disqualified to act as a director”;

(b)

by inserting, immediately after the word “address,” in subsection (2)(a), the words “his nationality,”;

(c)

by deleting the word “and” at the end of subsection (6)(d);

(d)

by deleting the words “, secretary or auditor” in subsection 6(e) and substituting the words “or secretary” and by deleting the full-stop at the end of that subsection and substituting the word “; and”; and

(e)

by inserting, immediately after paragraph (e) of subsection (6), the following paragraph:“(f)within one month of any change in the identification or nationality of any director, manager or secretary, a notice in the prescribed form notifying the Registrar of the new identification or nationality.”.
