New section 35A
The principal Act is amended by inserting, immediately after section 35, the following section:“Restoration of trade mark removed for non-payment of renewal fee35A.—
(1)
Where a trade mark has been removed from the register for non-payment of the prescribed fee, the Registrar may, within 12 months from the date of expiration of the registration of the trade mark, if satisfied that it is just to do so, restore the trade mark to the register, and renew the registration of the trade mark, either generally or subject to such conditions or limitations as he sees fit to impose, for a period of 10 years from the expiration of the last registration.(2) Section 78 shall not apply in relation to this section.”.
