Clause 6

Timing of poll and writ of election

(1)

Any poll for the election of the President shall be conducted as follows:

(a)

where the office of the President becomes vacant prior to the expiration of the term of office of the incumbent, within 6 months after the date the office of President becomes vacant; or

(b)

in any other case, not more than 3 months before the date of expiration of the term of office of the incumbent.

(2)

For the purposes of every election to the office of President, the Prime Minister shall issue a writ under the public seal, addressed to the Returning Officer.

(3)

Every such writ shall be in the prescribed form and shall specify the date or dates (referred to in this Act as nomination day) not being less than 5 days nor more than one month after the date of the writ and the place or places of nomination (referred to in this Act as the place of nomination).

(4)

Upon receipt of the writ, the Returning Officer shall proceed to hold the election in the manner provided in this Act.
