Clause 7

by deleting subsection (1) and substituting the following subsection:“(1) Where a plaintiff has a cause of action which exceeds the District Court limit in which, if it did not exceed the District Court limit, a District Court would have jurisdiction under section 20(1)(a) or (2) or section 21, the plaintiff may abandon the excess and thereupon a District Court shall have jurisdiction to hear and try the action, provided that the plaintiff shall not recover in the action an amount exceeding the District Court limit.”; and

by deleting the word “try” in subsection (2) and substituting the words “hear and try”.
