Clause 26

Section 178 of the principal Act is amended by deleting subsection (1) and substituting the following subsections:“(1) An officer appointed as an investigating officer under section 177(a) may only conduct an investigation where there is reason to believe that a military offence specified in the Schedule has been committed.(1A) A warrant officer appointed as an investigating officer under section 177(a) may only conduct an investigation where there is reason to believe that a military offence specified in the Schedule has been committed by a soldier who is below the rank of warrant officer.”.
