Clause 35

Section 89 of the Factories Act is amended by deleting subsection (3) and substituting the following subsections:“(3) In relation to a contravention which results in serious bodily injury to any person, the person guilty of an offence shall be liable on conviction to a fine not exceeding $25,000 or to imprisonment for a term not exceeding one year or to both.(4) In relation to a contravention which results in the death of one person, the person guilty of an offence shall be liable on conviction to a fine not exceeding $50,000 or to imprisonment for a term not exceeding one year or to both.(5) In relation to a contravention which results in the death of two or more persons, the person guilty of an offence shall be liable on conviction to a fine not exceeding $200,000 or to imprisonment for a term not exceeding one year or to both.”.
