Clause 9

Section 19 of the principal Act is amended by deleting subsection (2) and substituting the following subsection:“(2) Where an occupier is charged for abetting another person who has employed a foreign worker in contravention of section 5(1), it shall not be sufficient for the occupier to prove in his defence that he had instructed the other person not to, or obtained from the other person an undertaking that he would not, so employ a foreign worker.”.
