Repeal and re-enactment of section 107

Section 107 of the Employment Act is repealed and the following section substituted therefor:“Offences

107. Any employer who, without reasonable excuse, the proof of which shall lie on him —

(a)

neglects or refuses to produce any contract of service, book of account of salary, register or other documents concerning any employee or relating to that employee’s employment as required under section 105(1)(b);

(b)

hinders or obstructs the Commissioner or an inspecting officer in the exercise of the power under section 105(1); or

(c)

makes to the Commissioner or an inspecting officer exercising the power under section 105(1) a statement either orally or in writing which is false in a material particular,shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $1,000 or to imprisonment for a term not exceeding 6 months or to both.”.
