Clause 16

Offence to require directive as condition for insurance or medical care

(1)

Any person who requires or prohibits the making of a directive as a condition for being insured for, or receiving medical or health care services shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $5,000 or to imprisonment for a term not exceeding one year or to both.

(2)

Any condition of a policy of insurance referred to in subsection (1) shall be void to the extent that it requires or prohibits the making of a directive.
