Clause 10

Delegation of powers

(1)

The Board may, subject to such conditions or restrictions as it may impose, delegate to the Chief Executive, the Chairman or a committee appointed under section 9 all or any of the functions, duties and powers vested in the Board by or under this Act or any other written law, except the power to borrow money; and any power, function or duty so delegated may be exercised or performed by the Chief Executive, the Chairman or such committee, as the case may be, in the name and on behalf of the Board.

The Board may, subject to such conditions or restrictions as it thinks fit, delegate to any member or employee of the Board or any person all or any of its functions, duties and powers vested in the Board by or under this Act or any other written law, except the power to borrow money or to raise or grant loans or advances to or subscribe to stocks, shares, bonds or debentures of a company or corporation, and any power, function or duty so delegated may be exercised or performed by such member, employee or person in the name and on behalf of the Board.

The Board may continue to exercise a power conferred upon it, or perform a function or duty under this Act or any other written law, notwithstanding the delegation of such power, function or duty under this section.
