Amendment of section 7 of Unfair Contract Terms Act

Section 7 of the Unfair Contract Terms Act [Cap. 396] is amended —

(a)

by inserting, immediately after subsection (3), the following subsection:“(3A) Liability for breach of the obligations arising under section 2 of the Supply of Goods Act [Cap. 394] (implied terms about title, etc., in certain contracts for the transfer of property in goods) cannot be excluded or restricted by reference to any such term.”; and

(b)

by inserting, immediately after the word “cannot” in the sixth line of subsection (4), the words “(in a case to which subsection (3A) does not apply)”.
