Amendment of section 61

Section 61 of the Women’s Charter is amended —

(a)

by inserting, immediately after the word “child” in the second line of subsection (2), the words “of any age”;

(b)

by deleting the word “and” at the end of paragraph (c) of subsection (4), and by inserting immediately thereafter the following paragraphs:“(ca)the age of each party to the marriage and the duration of the marriage;

(cb)the contributions made by each of the parties to the welfare of the family, including any contribution made by looking after the home or caring for the family; and”; and

(c)

by deleting subsection (6) and substituting the following subsections:“(6) A court before which any application under this section is heard may give consideration to the possibility of a harmonious resolution of the matter and for this purpose may, at any stage in the proceedings, refer the parties for mediation or to attend counselling provided by such body as the Minister may approve or as the court may direct.(7) The court shall have the powers conferred by section 78 in respect of proceedings relating to maintenance under this section.”.
