Clause 18

Amendment of section 102

Section 102 of the principal Act is amended by deleting subsection (3) and substituting the following subsection:“(3) A Kadi shall not register any divorce or revocation of divorce unless he is satisfied after inquiry —

(a)

that the parties have consented to the registration thereof; and

(b)

in the case of registration of a divorce —

(i)

that all payments of emas kahwin, any consolatory gift or mutaah and any maintenance for the wife for the period of her iddah have been paid in full; and

(ii)

that the parties have no minor children and no matrimonial home.”.
