Clause 40

Repeal and transitional provisions

(1)

The Merchant Shipping (Oil Pollution) Act (Cap. 180) is repealed.

(2)

Notwithstanding subsection (1), the provisions of the repealed Act and the regulations made under the repealed Act shall, in lieu of the provisions of this Act and the regulations made under this Act, apply in relation to a ship, which, at the time of the discharge or escape of oil from the ship, or at the time the relevant threat of contamination arose, as the case may be, was registered in a country —

(a)

which was not a Liability Convention country; and

(b)

which was a country in respect of which the International Convention on Civil Liability for Oil Pollution Damage 1969 was in force.

(3)

Subsection (2) shall cease to have effect on 31st December 1998.

(4)

Nothing in this section shall be taken as prejudicing section 16 of the Interpretation Act (Cap. 1).
