Amendment of section 21
Section 21 of the principal Act is amended by deleting subsection (1) and substituting the following subsection:“(1) Any person who commits an offence under section 18, 19, 20 or 20A may be arrested without warrant by any police officer, public health officer, or public officer authorised in writing in that behalf by the Commissioner, and taken before a Magistrate’s Court or a District Court, as the case may be, and shall be liable on conviction —
in the case of an offence under section 20A(1), to a fine not exceeding $50,000 or to imprisonment for a term not exceeding 12 months or to both and, in the case of a second or subsequent conviction, to a fine not exceeding $100,000 and to imprisonment for a term of not less than one month and not more than 12 months;
in the case of an offence under section 18(1)(h), to a fine not exceeding $5,000 and, in the case of a second or subsequent conviction, to a fine not exceeding $10,000 or to imprisonment for a term not exceeding 3 months or to both; and
in the case of any other offence, to a fine not exceeding —
in the case of a first conviction, $1,000;
in the case of a second conviction, $2,000; and
in the case of a third and subsequent conviction, $5,000.”.
