Amendment of section 45
Section 45 of the principal Act is amended by inserting, immediately after subsection (8), the following subsection:“(9) Any person who fails to comply with a nuisance order served on him under subsection (1) shall be guilty of an offence and shall be liable —
in the case of a first conviction, to a fine not exceeding $10,000 and, in the case of a continuing offence, to a further fine not exceeding $1,000 for every day or part thereof during which the offence continues after conviction; and
in the case of a second or subsequent conviction, to a fine not exceeding $20,000 or to imprisonment for a term not exceeding 3 months or to both and, in the case of a continuing offence, to a further fine not exceeding $1,000 for every day or part thereof during which the offence continues after conviction.”.
