Amendment of section 8
Section 8 of the principal Act is amended by inserting, immediately after subsection (8), the following subsection: “(8A) A gift (including a gift made before the date of commencement of the Drug Trafficking (Confiscation of Benefits) (Amendment) Act 1999) is caught by this Act if —
it was made by the defendant at any time since the beginning of the period of 6 years ending when the proceedings for a serious offence were instituted against him or, where no such proceedings have been instituted, when an application under section 4A for a confiscation order is made against him; or
it was made by the defendant at any time and was a gift of property which is or is part of the benefits derived by the defendant from criminal conduct.”.
