Power of Director to require removal of hazardous substances from premises
(1)
If, in the opinion of the Director, the hazardous substance stored or kept in any premises is likely to threaten the health or safety of any person or to cause pollution of the environment, he may, by notice in writing, require the owner or occupier of any premises to remove the hazardous substance to a disposal facility.
(2)
The Director may, by notice in writing, require the owner or occupier upon whom a notice has been served under subsection (1) to furnish evidence that the hazardous substance stored or kept in the premises has been disposed of at a disposal facility in accordance with the notice.
(3)
Any person who fails to comply with a notice made under subsection (1) or (2) shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $50,000.
