Clause 38
Regulations for mandatory insurance
(1)
The Minister may make regulations to require an owner or occupier of industrial or trade premises or a person who handles, stores, transports or uses hazardous substances to take out and maintain policies of insurance in such circumstances and against liabilities for such risks, costs or damages as may be prescribed in the regulations.
(2)
Without prejudice to the generality of subsection (1), the regulations may provide for —
(a)
the terms and conditions including any minimum limit of indemnity of any policy of insurance required to be taken out or maintained under subsection (1);
(b)
the form of the certificate of insurance; and
(c)
the different terms and conditions in different circumstances.
