New section 140IA

The Copyright Act is amended by inserting, immediately after section 140I, the following section:“Compensation for failure to take action140IA.—

(1)

Where copies have been seized pursuant to a notice given under section 140B and the objector concerned fails to take infringement action within the retention period for the copies, a person aggrieved by such seizure may apply to the court for an order of compensation against the objector.(2) Where the court is satisfied that the applicant had suffered loss or damage as a result of the seizure of the copies, the court may order the objector to pay compensation in such amount as the court thinks fit to the applicant.(3) For the purposes of subsection (1), the retention period for seized copies is —

(a)

the period specified in a notice given under section 140E in respect of the copies; and

(b)

if that period has been extended under section 140E, that period as so extended.”.
