Clause 25

Directions affecting postal licensee

(1)

The Postal Authority may give directions to be observed by postal licensees —

(a)

to ensure the reliability of the provision of any postal service to the public;

(b)

to ensure fair and efficient market conduct by postal licensees; or

(c)

in the public interest.

(2)

A direction under subsection (1) —

(a)

shall require the postal licensee concerned (according to the circumstances of the case) to do, or not to do, such things as are specified in the direction or are of a description as specified therein;

(b)

shall take effect at such time, being the earliest practicable time, as is determined by or under that direction; and

(c)

may be revoked at any time by the Postal Authority.

(3)

Before giving a direction to any postal licensee under subsection (1), the Postal Authority shall, unless the Postal Authority in respect of any particular direction considers that it is not practicable or desirable, give notice —

(a)

stating that the Postal Authority proposes to make the direction and setting out its effect; and (b)specifying the time within which representations or objections to the proposed direction may be made,and shall consider any representations or objections which are duly made.

(4)

Any postal licensee who is aggrieved by any direction of the Postal Authority under subsection (1) may, within 14 days after the licensee is served with the direction, appeal to the Minister whose decision shall be final.

(5)

Every postal licensee shall comply with every direction of the Postal Authority given to the licensee under this section.
