Clause 37

Complaints Committees

(1)

The Board may appoint one or more committees, to be known as Complaints Committees, to investigate any complaint or information in respect of any of the following matters:

(a)

the conviction of a registered nurse, enrolled nurse or registered midwife of an offence which renders him unfit to remain on the Register or Roll;

(b)

any misconduct, or negligence, of a registered nurse, enrolled nurse or registered midwife which renders him unfit to remain on the Register or Roll;

(c)

the physical or mental fitness of a registered nurse, enrolled nurse or registered midwife to perform his functions.

(2)

A Complaints Committee shall comprise such number of members as the Board may determine, and the members may include members of the Board.

(3)

The Board shall appoint a member of a Complaints Committee as the Chairman of the Complaints Committee.

(4)

The Board may at any time revoke the appointment of any Complaints Committee or remove any member of a Complaints Committee or fill any vacancy in the Complaints Committee.

(5)

Subject to any regulations made under section 44, a Complaints Committee shall have the power to regulate its own procedure.

(6)

A Complaints Committee shall, within 3 months from the date a complaint or matter is referred to it or such further period as the Board may grant, complete its investigation on the complaint or matter and report its findings and recommendation to the Board.

(7)

A member of the Board who is a member of a Complaints Committee investigating any complaint or matter against a registered nurse, enrolled nurse or registered midwife shall not take part in any deliberation by the Board under section 19.
