Clause 23

Evasion of restrictions on donations

(1)

Where a person —

(a)

enters into; or

(b)

knowingly does any act in furtherance of,any arrangement which facilitates or is likely to facilitate, whether by means of any concealment or disguise or otherwise, the making of donations to a candidate, election agent or political association by any person or body other than a permissible donor, he shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $3,000 or to imprisonment for a term not exceeding 12 months or to both.

(2)

Where a person —

(a)

knowingly gives an officer of a political association or a candidate or his election agent any information relating to the identity of the donor or the amount of any donation made to the political association or the candidate or election agent or to the person or body making such a donation, which is false in a material particular; or

(b)

with intent to deceive, withholds from any officer of a political association or a candidate or his election agent any material information relating to the identity of the donor or the amount of any donation made to the political association or candidate or election agent or to the person or body making such a donation,he shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $3,000 or to imprisonment for a term not exceeding 12 months or to both.
