Clause 4

by inserting, immediately after paragraph (a) of subsection (3), the following paragraph:“(aa)take all reasonable steps and exercise due diligence in ensuring that the structure of the building is designed in accordance with the provisions of this Act and, subject to section 14, the requirements for structural design and loads prescribed in the building regulations;”; and

by inserting, immediately after subsection (5), the following subsection:“(5A) Any qualified person who contravenes or fails to comply with subsection (3)(aa) shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $100,000 or to imprisonment for a term not exceeding 12 months or to both.”.
