The Registrar or any person authorised by him in writing may, in his discretion, compound any offence under this Act or any rules made thereunder which is prescribed as a compoundable offence by collecting from a person reasonably suspected of having committed the offence a sum of money not exceeding $2,000.(2) The Office may, with the approval of the Minister, make regulations to prescribe the offences which may be compounded.(3) On payment of such sum of money, no further proceedings shall be taken against such person in respect of the offence.(4) All sums collected under this section shall be paid into the funds of the Office.”.(c)Section 106 (1st line) (including marginal note)Delete the word “Government” wherever it appears and substitute in each case the word “Office”.(d)Sections 110(1) (1st line) and 115(1) (1st line) Insert, immediately after the words “Minister may” wherever they appear, the words “, after consulting with the Office,”.(e)New section 115AInsert, immediately after section 115, the following section:“Fees to be paid to Office115A.—
All fees collected in connection with any proceedings or other matter before the Registrar or the Registry, or in connection with the provision of any service by the Registry, shall be paid into the funds of the Office.(2) Subsection (1) shall not apply to fees paid under section 85 which are to be forwarded to the International Bureau.”.(6)Statutory Bodies and Government Companies (Protection of Secrecy) Act (Cap. 319) The Schedule Part IInsert, immediately after item 8, the following item: “8A.Intellectual Property Office of SingaporeIntellectual Property Office of Singapore Act 2001.”.(7)Trade Marks Act (Cap. 332) (a)Section 2(1)Insert, immediately after the definition of “international trade mark (Singapore)”, the following definition:“ “Office” means the Intellectual Property Office of Singapore incorporated under the Intellectual Property Office of Singapore Act 2001;”.(b)Section 74(i)Delete the word “Registrar” in subsection (1) and substitute the words “Office and the Registrar”. (ii)Delete the words “The Registrar is not” in subsection (2) and substitute the words “Neither the Office nor the Registrar is”. (iii)Delete the word “Registrar” wherever it appears in subsection (3) and substitute in each case the words “Office or the Registrar”.(c)Section 77Insert, immediately after subsection (2), the following subsections:“(3) All fees collected shall be paid into the funds of the Office.(4) Subsection (3) shall not apply to fees prescribed in rules made under section 54(2)(g) which are to be forwarded to the International Bureau.”.(d)New section 105AInsert, immediately after section 105, the following section:“Composition of offences105A.—
