Amendment of section 28

Section 28 of the Patents Act is amended by deleting subsection (1) and substituting the following subsection:“(1) Where —

(a)

an application for a patent has a date of filing;

(b)

the application is not withdrawn or treated as having been abandoned; and

(c)

one or more claims for the purposes of the application have been filed in accordance with section 26(8),the Registrar shall, as soon as practicable after the end of the prescribed period, examine the application so as to determine whether the application complies with those requirements of this Act and the rules which are designated by the rules as formal requirements for the purposes of this Act.”.
