Power of court to order observance or enforcement of business rules
(1)
Where any person who is under an obligation to comply with, observe, enforce or give effect to the business rules of a clearing house, fails to comply with, observe, enforce or give effect to any of those business rules, the High Court may, on the application of the Authority, a clearing house or a person aggrieved by the failure, and after giving to the person against whom the order is sought an opportunity to be heard, make an order directing that person to comply with, observe or enforce, or give effect to, those business rules.
(2)
For the purposes of this section, “person” includes a clearing house.
(3)
This section is in addition to and not in derogation of any other remedies available to the aggrieved person referred to in subsection (1).
