Clause 98

Appeals

(1)

Subject to subsection (2), any person who is aggrieved by —

(a)

the refusal of the Authority to grant, renew or vary a licence;

(b)

the revocation or suspension of a licence by the Authority;

(c)

the issue of a prohibition order by the Authority;

(d)

the refusal of the Authority to grant an approval to a holder of a capital markets services licence to appoint a person as its chief executive officer or director; or

(e)

the direction of the Authority to a holder of a capital markets services licence to remove an officer from office or employment,may within 30 days after it is notified of the Authority’s decision, appeal to the Minister whose decision shall be final.

(2)

An appeal under subsection (1)(d) or (e) may only be made by the holder of a capital markets services licence.
