Clause 41

Supply of piped water for human consumption with approval of Board

(1)

No person other than the Board shall supply piped water for human consumption except with the written approval of the Board.

(2)

Any person who contravenes subsection (1) shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $50,000 or to imprisonment for a term not exceeding 5 years or to both.

(3)

Every written approval given by the Board shall be in such form and for such period and may contain such terms and conditions as the Board may determine.

(4)

No written approval given by the Board shall be transferable without the prior consent in writing of the Board.

(5)

Any purported transfer of any written approval shall be void.

(6)

If a person who has been given written approval contravenes any of the terms and conditions of such approval or section 42, the Board may require that person to show cause in writing why the Board should not do any of the following:

(a)

require that person to provide security in such form and of such amount as the Board considers appropriate for securing compliance with the terms and conditions of the approval or section 42;

(b)

impose on him a financial penalty not exceeding $50,000; or

(c)

revoke the approval or suspend it for such period as the Board considers appropriate.

(7)

If the Board is not satisfied with any written representation or explanation of the person required to show cause under subsection (6), the Board may —

(a)

require that person to provide security in such form and of such amount as the Board considers appropriate for securing compliance with the terms and conditions of the approval or section 42;

(b)

impose on him a financial penalty not exceeding $50,000; or

(c)

revoke the approval or suspend it for such period as the Board considers appropriate.

(8)

The financial penalty imposed under subsection (7) shall be recoverable as a debt due to the Board.

(9)

Any person who is aggrieved by a decision of the Board under subsection (7) may, within 14 days of the receipt by him of the decision, appeal to the Minister whose decision shall be final.

(10)

This section shall not apply to the supply of piped water for human consumption solely to the Board.
