Amendment of section 38
Section 38 of the principal Act is amended —
by deleting paragraph (k) of subsection (1) and substituting the following paragraphs:“(k)to regulate the seizure and disposal of unwholesome meat, fish, fruit, vegetables or other food or drink exposed or intended for sale;
(ka)to prescribe the fees for licences and to prescribe the fees and charges for any of the purposes of this Act or any regulations made thereunder;
(kb)to prescribe that any act or omission, or any contravention of the provisions of any regulations shall be an offence and to provide for the imposition of a fine not exceeding $5,000 and, in the case of a continuing offence, a further fine of $500 for every day or part thereof during which the offence continues after conviction; and”; and
by inserting, immediately after subsection (2), the following subsection:“(2A) The Minister may, in making any regulations, prescribe the circumstances in which it shall be presumed that an offence under the provisions of any such regulations was committed.”.
