Clause 6

Amendment of section 17

Section 17 of the principal Act is amended —

(a)

by deleting subsection (1) and substituting the following subsection:“(1) The Minister may by regulations require any person who —

(a)

imports;

(b)

distributes;

(c)

sells or offers for sale; (d)permits to be sold or offered for sale; (e)has in his possession for sale,any tobacco product to be licensed by the Chief Executive.”; and

(b)

by deleting the words “sells by retail or offers for sale by retail or permits to be sold or offered or has in his possession for sale by retail any tobacco product without a licence in force” in the 2nd to 5th lines of subsection (4) and substituting the words “carries out any activity referred to in subsection (1)(a) to (e) without a licence in force in respect of that activity”.
