Clause 9

Amendment of section 55

Section 55 of the principal Act is amended —

(a)

by deleting the comma at the end of subsection (1)(e)(ii) and substituting a semi-colon;

(b)

by deleting the words “that the Director or Health Officer has reason to believe will be useful for the purposes of the investigation into the outbreak or suspected outbreak;” in subsection (1)(e); (c)by deleting the words “who is suspected of being infected with” in subsection (1)(f) and substituting the words “who is, or is suspected to be, a case or carrier or contact of”; and

(d)

by inserting, immediately after subsection (3), the following subsection:“(3A) A person shall comply with a requirement under subsection (1)(e) to disclose information or produce documents to the Director notwithstanding any restriction on the disclosure of the information or documents imposed by any written law, rule of law, rule of professional conduct or contract; and the person shall not by so doing be treated as being in breach of any such restriction notwithstanding anything to the contrary in that law, rule or contract.”.
