New section 284A
The principal Act is amended by inserting, immediately after section 284, the following section:“Authority may disapply this Division to certain offers and invitations284A. Notwithstanding any provision to the contrary in this Division, where —
an offer to the public of, or an invitation to the public to subscribe for or purchase, units in a collective investment scheme is one to which (but for this section) both this Division and Division 1 apply; and
the Authority has by order published in the Gazette declared that this Division shall not apply to that offer or invitation or a class of offers or invitations to which that offer or invitation belongs,then this Division does not apply to that offer or invitation.”.
