Clause 22

Penalty for offences under Parts II and III

Any person who is guilty of an offence under Part II or III shall be liable on conviction —

(a)

in the case of a body corporate, to a fine not exceeding $200,000 and, in the case of a second or subsequent offence, to a fine not exceeding $400,000; and

(b)

in any other case, to a fine not exceeding $100,000 or to imprisonment for a term not exceeding 12 months or to both and, in the case of a second or subsequent offence, to a fine not exceeding $200,000 or to imprisonment for a term not exceeding 2 years or to both.
