Amendment of section 183

Section 183 of the Companies Act is amended —

(a)

by deleting the words “in legible form or a permitted alternative form, or by making accessible to the member in accordance with section 173A” in subsection (3A); and

(b)

by inserting, immediately after subsection (7), the following subsection:“(8) For the purposes of this section, something is “in legible form or a permitted alternative form” if, and only if, it is sent or otherwise supplied —

(a)

in a form (such as a paper document) that is legible before being sent or otherwise supplied and does not change form during that process; or (b)in another form that —

(i)

is currently agreed between the company and the person as a form in which the thing may be sent or otherwise supplied to the company; and (ii)is such that documents sent or supplied in that form can (where particular conditions are met) be received in legible form or be made legible following receipt in non-legible form.”.
