Amendment of section 82

Section 82 of the Copyright Act is amended —

(a)

by deleting the full-stop at the end of paragraph (b) of subsection (1) and substituting a semi-colon, and by inserting immediately thereafter the following paragraphs:“(c)to publish the sound recording if it is unpublished;

(d)

to make available to the public a sound recording by means of, or as part of, a digital audio transmission.”; and

(b)

by inserting, immediately after subsection (2), the following subsection:“(3) For the avoidance of doubt, “make available” for the purposes of this Part does not include the causing of a sound recording to be heard, otherwise than by means of or as part of a digital audio transmission.”.
