Amendment of section 252

Section 252(1) of the Copyright Act is amended ––

(a)

by deleting paragraphs (a) and (b) and substituting the following paragraphs:“(a)makes a direct or an indirect recording of the performance in any manner or medium;

(b)

communicates the live performance to the public;”;

(b)

by deleting the word “or” at the end of sub-paragraph (d); and

(c)

by deleting the full-stop at the end of paragraph (e) and substituting a semi-colon, and by inserting immediately thereafter the following paragraphs:“(f)publishes the recording of the performance if it is unpublished; or

(g)

makes available a recording of the performance to the public (on a network or otherwise) in such a way that the recording may be accessed by any person from a place and at a time chosen by him.”.
