Clause 40
Delegation of powers
(1)
The Minister may, subject to such terms or conditions as he thinks fit, delegate to any person all or any of his powers, functions and duties under this Act, except —
(a)
the power of delegation conferred by this section; and
(b)
the power to make subsidiary legislation.
(2)
The Minister may exercise any power or perform any function or duty conferred upon him under this Act notwithstanding the delegation of that power, function or duty under subsection (1).
