Clause 39

Power to require information in respect of contraventions

(1)

Where it appears to the Commissioner or any authorised officer that there may have been a contravention of any provision of this Act, he may serve an information notice to require any person who appears to him to be acquainted with the circumstances of the case to furnish him, within such time as may be specified in the notice, with information relating to that case in the possession or within the knowledge of that person.

(2)

An information notice under subsection (1) shall be complied with by giving the required information in writing to the Commissioner or authorised officer, as the case may be.

(3)

Any person who fails to comply with any notice under subsection (1) shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $10,000.

(4)

It shall be a defence for a person charged with an offence under subsection (3) to prove that he did not know and could not with reasonable diligence have ascertained, the information required in the information notice.

(5)

If any person —

(a)

makes any statement purporting to comply with a requirement of an information notice which he knows to be false or misleading in a material particular; or

(b)

recklessly makes such a statement which is false or misleading in a material particular,he shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $10,000.
