Clause 13

Amendment of section 79

Section 79 of the principal Act is amended —

(a)

by deleting subsections (1), (2) and (3) and substituting the following subsections:“(1) Any person who drives or causes to be driven on any road a heavy motor vehicle the overall height of which exceeds 4.5 metres without being escorted by a police officer, or an auxiliary police officer appointed in accordance with any written law, shall be guilty of an offence.(2) A person guilty of an offence under subsection (1) shall be liable on conviction —

(a)

for a first offence, to imprisonment for a term of not less than one year and not more than 3 years and, in addition, to a fine not exceeding $2,000; and

(b)

for a second or subsequent offence, to imprisonment for a term of not less than 2 years and not more than 5 years and, in addition, to a fine not exceeding $5,000.”;

(b)

by deleting the words “The driver or person in charge of a heavy motor vehicle convicted of an offence under subsection (1) or (3)” in subsection (4) and substituting the words “A person convicted of an offence under subsection (1)”;

(c)

by deleting the words “and section 80” in subsection (6); and

(d)

by deleting the section heading and substituting the following section heading:“Offence for driving heavy motor vehicle without police escort”.
